You simply cannot get 18 month for shoplifting at all. Maybe in years past....but then you could dunk your wife in the village pond for gossiping years ago as well. In my experience magistrates, today, in the ones I have observed, haven't been that way and in the vast majority of cases I could see their reasons and thought process. 7 years is maximum crown can give for theft qndvshop lifting is theft is it not ? Magistrate can give 12 months but can send it to crown , Think you need to study bit more

From what I've seen,in life and in court....the full story never matches the headline . I suspect these days the courts are so backed up that they try and move the small stuff through as quick as possible. They are chucking them out of nick as quick as they can put them in, the whole lot is probably bursting at the seams.

All depends on the court , Only people in magistrate courts who no the law is the Clark and the defence solicitor and prosecution, the 3 beaks no f all about the law and that's why they ask the Clark what they can and can not do , I've never got a not guilty in mag ,but walked several times in crown
chartpolski 27,120
I thought magistrates can only give up to 6month ? May be wrong, as I'm a law abiding, pillar of the community ! Cheers.

I have actually said....up to to 2 years now and can commit to crown for sentencing. Again I cleared up my point that you aren't going to get 18 month for a pack of bacon or a KitKat. With many other things coming into play and other offences maybe.

As the jury deliberated , my brother said he would never find the old boy guilty. He said the old chap may have just forgot he had the bacon, or he may have been desperate for something to eat, and either way, why should 12 people take days off work for the price of a packet of bacon ? Common sense prevailed, the old chap was found not guilty......what a waste of time and money. Cheers. Did the bacon have the rind on?
Squirrel_Basher 17,102
Many years ago 3 of us were on a charge of disturbing a badger sett and baiting a wild animal .The baiting was because we were in cuffs whilst the terrier fought the fox in a stop end . So the day arrives when we were to go to magistrates court .We never got inside the door .One of the coppers had disclosed that the wildlife officer had gone to a live sett nearby to verify it was in use and had written a different set of map co ordinates that wasn’t made available to our brief . I knew the copper from a shoot syndicate .All charges dropped .It worked to our advantage that day . We were digging in a pig sett but to a fox we’d run in 1
