After announcing that the RSPCA would take the case to appeal, its barrister also indicated that he would withdraw all other charges against our various clients except for one offence against a single member of the group who had pleaded guilty to a relatively minor charge early on. The remaining charges were mostly under the Protection of Badgers Act and the Deer Act and (we say) largely arose as a result of a large number of nonsense emails, telephone messages and other social media exchanges between a group of friends never designed to be viewed by any court. These were no more than a group of friends bragging up each others' dogs. The decision was that section 8 of the Animal Welfare Act was confined to animal fighting proper and was NOT (as the RSPCA suggested), ANY fight between say a lurcher and a fox in the context of a hunt. The decision upheld the old law under the Protection of Animals Act 1911 - which the Animal Welfare Act replaced - to the effect that only CAPTIVE animals could be the subject of fighting. The proper way to charge hunting offences was, said DJ Grey, to do so under the Hunting Act 2004. If the charge could not be brought within that legislation it could not succeed. The defence lawyers, myself included, believe that DJ Grey was 100% correct in his interpretation of the law, and we believe that the High Court will uphold this common-sense decision. The lad who the case was about has had everything dropped and his dogs are in the proses of being returned !!!! So basically they should no longer charge people with keeping dogs for animal fighting , being present at an animal fight ,casing a dog to fight a wild animal It means if i am correct they have to charge you under the hunting act and not the AWA so there is no animal bans or massive fines and animals should be returned to owner and not destroyed I hope this is a stepping stone to there departure and demise 26 Quote Link to post Share on other sites

The one what they handed back to you in a plastic bag? Well done so far and for standing your ground. RSPCA and Anti wankers should leave us be and target the sickos out there interfering with kids.
