Small Claims Court

Are there any self employed lads on here that have had to go to Small Claims Court for payment of wages ? What's the procedure ? Or is it legal to sell the dept ?

Just over £200 owed :thumbs:

send them a letter on your headed paper setting out what they owe you a date when you want it paying by and your intentions if its not paid,i used to use a company that charged a few quid for a letter and I got paid every time but they don't do a follow up service just a snotty letter -- small claims can take months to get to court

You will have to send whoever owes you money a letter as stig said. Dated and with a date you wish to be paid by before you can start a claim through the courts.

Cheers lads :thumbs: I've never been knocked in my life and don't intend to start now . It's only just over £200 but it's the principal :thumbs:

glad I`m out the job, these days mines 100% cash out cash in now ..

Before spending £80 on fees is there proof he owes you money, ie can you prove it, is it your word against his? You will need to write why he owes you the money and if he says never heard of you, never employed you or that you said you would work a week free then you will find it hard to convince a judge. The process is not a court it's just sitting round a table and all the judge is interested in is written facts, if you have anything to prove he said he would pay you £200 go for it, if you don't then you may be throwing away more money.

 

I've used the court a few times and mostly the threat of being taken to court as you can add court fees and if you win judgement you can claim interest from the date of judgment.

If you have the proof and they don't pay after your letter, which should include a deadline, then use the government's Money Claim Online system. The link to it is on the web page given in an earlier post. If you win and they still don't pay, there's a number of ways to enforce, but costs do keep adding up if you don't succeed. If they are working somewhere and on PAYE, you can get an attachment to earnings to recover the debt, but obviously only after you've won the case and then they've not paid.

i went through the process online and right before i paid i printed out the filled in form and sent it to the incredibly wealthy dr who refused to pay me the 125 quid she owed me

with that form i sent a letter saying unless i received payment within five working days i would be filing the claim

curiously cheque in the post two days later

hope that makes sense
