Ideation 8,217
Ok, this might sound stupid, but bear with me . . . . . It's illegal to kill a fox with your dog, we all know that. And at various points people have debated about what the legality is of being out for just a walk and your dog accidently catching and killing a fox, and i think it pretty much always goes, that its your duty to be able to control the dog, and have it on a lead or under control etc, so its your fault and still illegal, accident or not. But. . . . . . . How about if your dog/s were under control, confined in your yard, and a fox decided to enter your yard, and in the process get killed by your dog / s? Now obviously folk may suggest just keeping your mouth shut, but that may not be an option if someone had seen your dogs new toy before you got home. Any ideas, thoughts or musings??? SEAN3513 7
Its blatent case of tresspass........but , im sure it would still be seen as illegal Or perhaps its like the difference between murder and manslaughter ??
Baghdadnights 150
Let's face it if you own a hunting dog of any description were f****d if it kills anything anywhere
Ideation 8,217
That's what i was wondering sean. At the end of the day, the dogs are 'under control' in the sense that they are being confined on private property. There is no 'intention' As for owning a hunting dog, this scenerio, could play out with any number of 'pet' or guard breeds. I.e - if i legaly had an alsation running lose on my property behind i decent perimiter fence, and the fox scaled it and got in, and found itself on the wrong side of the Alsation, if that breaking the hunting ban?
dai dogs 1,955
if the dogs in question were gun dog types you would be ok....
secretagentmole 1,701
What so the dogs shoot the fox?
Ideation 8,217
Unfortunatly no . . . . . . . This is a genuine question lads and ladettes . . . . . it seems to me like it should be ok, but somehow i think they would still try to feck you? But not sure on what grounds??? A lot of folk, even in cities, keep chickens in the back yard, in a coop, and often also have a pet dog, say a staffie, running lose in their back yard, and as we all know there are a lot of foxes in urban areas, so if one decided to come into your enclosed garden, and instead of chickens, met the dog, and was promptly munched. . . . . is that prosecutable under the hunting act??? secretagentmole 1,701
Can't be prosecuted as the dog was not hunting, it was defending it;s territory! Also the fox was carrying out a verminous attack, got met by a highly advanced vermin trap with 44 point locking system....
dai dogs 1,955
What so the dogs shoot the fox? NO, the gun dog type of dogs do nothing wrong in the eyes of our so called leaders & the powers that be...
Chid 6,738
I think if you had signs up saying Dog loose on premises You'll be fine as it was the foxes fault for ignoring the warning signs lol
