You don't say what type of gun? Air Rifle, Shotgun, FAC Rifle? You also don't say what type of criminal record or from when or if it was custodial?

 

  • If you have received a custodial sentence of 3 months but less than 3 years then you are prohibited for a period of 5 years from the date you are released.
  • If you have received a custodial sentence of 3 years or more then you are prohibited for life, from the date of release.

I cant find anything regarding if the custodial sentence is suspended? So on the face of it I`d say you are prohibited for a period of 5 years from the date you are released or your suspended sentence is served? In your case 7 years? You need to check with the courts and your local FLO as the type of sentence may also have a bearing?

The fact you where a bad boy I would say the same you've no chance , they really hold a gun to your head with your license any offence , report from the public, drink or driving offence and there ready to lift your guns or refuse your certificate they want you to live like mother Theresa

If your with him and it's his gun, his licence then your fine for the shotgun. The air rifle you can use with out his presence, the only problem you'd have would be getting a certificate your self.

This is a vague answer as we don't know the reason for the conviction, I have a family member who has a firearms conviction. He is banned for life from handling any gun including an air rifle.

It depends how old the conviction is.

 

In July 2014 the law changed to include suspended custodial sentences.

 

Prior to that, a suspended sentence would not be included in the prohibition to possess firearms.

 

If your suspended sentence does count and it's within five years of the start of that sentence, not the period it was suspended for, then you cannot possess any firearm, be it with a licensed certificate holder or not. That includes antique firearms.

And it's all about to change again by the looks of things...the Law Commission has produced it's final report on trying to combine all 30 odd pieces of firearms legislation to make it easier to implement and enforce.

 

In fairness, it needs updating. Most of our legislation was enacted nearly 50 years ago when things were very different.
