allotments

Recommended Posts

ok, my mate has a allotment on farmland (not council owned) and apparantley the farm is going to move them...

the lads have a 99 year lease to be there, however the farmer wants to move them to the field next door

now this is ok if you only have afew vegetables etc to grow..but there are lads there with stables,....concrete floors, breeze block buildings,...some lads build sheds in there steel buildings etc,...and for some it would be impossible to move there buildings

so my question is....does someone have to come out and give these lads compensation for there gardens?

Superficially at least, it sounds like a clear and blatant Breach of Contract, doesn't it? But there's ye key word, mate: " Contract ". The answer may well be written there, in plain enough english that ye'd be able to suss it out for yeself. Then, if ye reckon ye have a case? Time for a word with Farmer Giles there, isn't it?

There after it could start getting expensive for one or the other and, most probably, unpleasent for all concerned :(

cheers for the replies

That would be absolutley devestating to the people concerned, it can take years to get an allotment and the plants fully mature

MOLL.

yes molly,..very true and it would be a shame...however with no respect to the lads and lasses growing things, the lads with the stables and buildings etc will have the most to lose in my eyes,...they have some very impressive set ups and some of it cant be moved....yes they could always start building again, but what about the time, money etc thats been spent on there present plots

whether it will happen who knows,.....hopefully not

Hi valentino whats the reason behind the move why does the farmer want them to move to the other field is there a ulterior motive .I have known allotments that have been taken over and the new owner put the rents up so high he forced people off the land then sold it for housing hope this not the case for the people concerned it might pay them to get legal advice.

If they really have a 99 year lease then the land is theres untill the end of the lease but do they pay a rent on top. If so then that could be a problem as has been said get advice.
