The main problem in Scotland is that "evidence" placed in front of these fiscals is not being properly challenged by lawyers especially legal aid lawyers. They look at the "evidence" presented by the prosecution and down to lack of specialist knowledge tell the accused to plead guilty. Whereas once a wildlife consultant looks at the "evidence" from the defence side a lot of the "evidence" is thrown out. Remember that recent case in Lanark the charges have not been proved in court the accused pled guilty so the charges were not tested in court. The same charges in the case in Duns were defeated in court we have very good wildlife lawyers but remember as soon as you are caught /challenged /questioned on an alleged wildlife crime the full legal process starts trying to Jail you so to give yourself a chance you better start right away as well. Do'nt think it will go away IT WONT get advice right away from a specialist lawyer or consultant (pm me) if you need details. By the time you have been granted legal aid the other side have had maybe three months start. Do, not speak to them UNTIL you have spoken to a specialist lawyer do not answer any questions from the SSPCA /RSPCA. you still have the right to remain silent. When you tell them anything they will use it against you. Remember you think you are answering "simple"questions say two of you have been picked up on permisssion after foxes all legal. they say you were after badgers on farm A you say no We werent we were after foxes on farm B so know they know where you were they will go and check for signs of badger on farm B they said you, you said we. You have just stuck your mate in. They go in and say to him your mate said you were after badgers on farm B your mate says no we werent we didnt go near the badger sette his terrier ran up to it but we shouted it back. So they say to you we are going up to the badger sette to look for DNA from your dog You then remember your terrier ran up to the hole stuck its head in you shouted it it backed away from the hole and SHAKES leaving hairs DNA on the mound You stopped and had a fag there put the fag out your DNA on that. This is how it builds up remember NAME ADDRESS DOB to the police thats all till you have spoken to a SPECIALIST lawyer Do not take legal advice from the Police they are not on your side.

Yes the lawyer he had was the one we use in SACS the SGA also use him he's absolutelly top notch and of course it does'nt suit the story that the only one who fought the charges was found not guilty.

 

Never truer statement, the mans not cheep but hey you get what you pay for, sad thing is these charities rely on people giving in due to costs and time span.

 

the best advice I can give is join SACS before its too late as I believe the legal costs to fight them escalated to £30,000.

 

 

Thing is SACS members get this for FREE!!!!!!! there is no other organisation wich can protect you like that.

it started as a post of info, turned to supposed grasses then to decent proven usefull advice !

is an advert not to make money no matter true or false and not to advise people of what they are entitled to and what there actual human rights are is that not the most logical step not to maintain those rights for the better of our beliefs and tradition for the countryside .

 

the purpose of this topic was for awareness and actual outcomes when one is challenged.

 

 

if people fail to even ask never mind persue what has been mentioed throughout this topic appart from the usuall smart arse then they have no one to blame bar themselvs..........

One thing I will say is you do NOT have to have comitted ANY crime to end up in the Dock in Scotland as anything goes will confirm but you still have to DEFEND yourself if innocent at your own expense. Remember even the old bits of rough ground that everybody used to ferret at the edge of the scheme or round the school pitches will ge you charged now. All anything goes was preaching was better safe than sorry.
