I purchased in good faith a new Hatsan Escort semi auto shotgun at the weekend from a dealer. Purchased in the understanding that it was a Sec 2 shotgun. However once I got home and registered my guarantee online once I entered the serial number it came up as a Sec 1 shotgun. Upon closer inspection I found it carries 4 shells in the tube and 1 in the breach. I do have a firearms license as well as shotgun cert although I dont currently have a slot for a Sec 1 shotgun on my FAC. What should I do to make this legal and above board ? Is it just a case of transfering the said firearm from my shotgun cert to my Fac via a variation ? Advice please gents

Get it took back asap, yes it's not your fault but technically I suppose your in possession of a section 1 without a slot,it's looks like the gun shop should get a severe bollocking, in sure it can be sorted before things turn ugly,if you have good reason to possess a gun of this kind apply for a variation,but personally if it was me I would get it out if my possession like yesterday,it's between u and the gun shop and probably best it's kept that way until u take it back,I think they will be a little embarrased mate, have u tried to get more than 3 shells in it just incase it's a paperwork error ????

take it back and get the dealer to get the tube crimped so it can only hold 2 or get him to replace the tube, get it took back asap as your foul of the law and could end up in big trouble through no fault of your own mate.

Cheers for the replies, much appreciated. Only problems I have here fellas is that the authorities have already been notified of the sale. The place I purchased it from is closed today & I won't be able to take it back until next week as I'm working away from home. May just email my police firearms dept explaining my problem in the meantime, nothing but answerphones everywhere today :S

when you notified them did you tell them its a 3 shot On the gun transfer sale and not 5? If so I guess they are none the wiser it's a 5, just hang fire and get in touch with the dealer asap and get it crimped, once you involve the feo things get messy mate,cos at the end of the day your the only one in breach of your cert all being it's not one bit your fault at all, if you do decide to inform the police they should be understanding,I can't believe that gun dealer has put you in this situation,tell him to do the alteration to the gun for free and you want some extras for free lol,and apart from that I guess it's only you and us on here know about this,there's time to put it right yet lol, I dont know what I would do,prob speak to the dealer Tom and nip it back,

Don't forget to give the fella a good telling off

What information was on the paperwork I can't say, authorities were notified of the transaction via the net at the time of the sale, my copy was placed in a self sealed envelope which has now been posted off. I know that with air rifles, once one has been taken above 12ft lbs and registered as a sec 1 firearm it will always remain on record as a Sec 1 firearm even if its taken back to 12ft lbs.....would this also apply in my case with chopping/capping the magazine tube ? I reckon its always on file as sec1 shotgun regardless. What a mine field of cluster f*<&s this is :$

Not sure on that once a sec 1 always a sec1 with shottys,I know thats true of air guns,let us know the out come mate,he's obviously not acted very professional has he,I would ring him in the morrow and ask his advice if you can put any more trust in the fool,his fook up not yours, chances are he's given you the gun thinking it's a 3 shot and as he didnt ask to see your fac for the sec 1 so maybe he filled the on line form in as a 3 shot,just a shot in the dark,hope you get it sorted hassle free keep us posted

Just phone the shop tomorrow and explain. At the end of the day they have supplied you with a sec 1 firearm and I am 101% sure they would not want to risk their RFD anymore than you would your FAC&SGC. Mistakes happen, thats why we are human. The police will be none the wiser. I would suggest that the easiest way to get around it would be for the gun shop to swap a mag tube from another shotgun in to yours, that way the serial numbers will all match, it's a 5 minuet job and of course chuck you 250 cartridges for your time and worry.

You are currently in possession of a section one firearm without a certificate. The fact that this is by someone elses omission is neither here nor there. If for any reason the police decide to check on it, for example they see a post on a forum, then you will be in deep doggy doo doo. Say goodbye to your FAC and SGC for starters.

 

The RFD has committed a serious breach by supplying a section one firearm to someone who does not have the proper authorisation, so he would be in deep doo doo too, a good bargaining chip!

 

You need to get it back to him ASAP. Even if it means losing some work. A conviction for possession of a S1 without the proper paperwork will cost you a whole lot more! (And I'd be asking the RFD to cover any costs due to his f##kup anyway!)

 

Do NOT contact the police about it. At least not until the weapon is out of your possession, and I'd be reluctant to say anything to them at any time. Whether it was your fault, or intentional, you are in possession of something that you shouldn't be. You know that the penalty for possession of a firearm without authorisation is up to five years as a guest of her majesty right?

Good advice. Even though you've notified the police, I'd suggest to the dealer that he crimps it, then notifies the police of its sale and remind him that he'd probably lose his RFD if it were to come out...

Although I agree with much of what has been said on this thread, I personaly don't think you would be at risk of losing your Certificates in this case. You bought the gun in good faith and trusted the RFD. As long as you make every effort to return the gun as soon as the Dealership is open then I cant see how you could be punished. However the RFD could be in trouble for the mistake. As for the case of the ex soldier being charged for handing in a gun he found, there is a liittle more to the story than that comment would have you beleive.

Cheers guys for all your input, I took the said weapon back to the dealer 1st thing which meant taking time out from work for a couple of hours but hey ho, they were surprisingly very laid back about it, turns out it had been one huge administration cock up. They sold it and had it on the shelf as a Sec 2 weapon and knew nothing about it being sec 1 untill I raised the issue. Made my feelings clear, left it in their hands to sort out and basically covered my ass. Now awaiting the outcome ! ;)
