My boss, has not been paying us regular, it does eventually come in, but i have went 2 weeks without wages.... do i have grounds for a claim against him? it says in our contract tthat we will be paid on a WEEKLY basis !!! a lot of lads are pissed off about it

 

EDITED to say WEEKLY, rather than REGULAR

If it's down in the contract, it should give you the payment terms, including when. If he's not sticking to this, he's breaking his side of the contract. Simple as that.

 

 

it doesnt specify a day which they will go on... but surely "weekly" legally means within a 7 day period? if i get paid on a wednesday, then get nowt till next friday, tthen tthose 2 dates dont come under the term "weekly"

 

i can dig out past bank statements, & highlight all his "payments" & draft them onto a calendar, then any numpty will realise that something is not right there :D

You probably do have grounds for a claim but it will certainly hasten your departure , these days some moneys better than none .does he pay you all he's owe you although its late ?

i am paid what i am owed normally, but havent been paid now since 26 feb.... and al bet £1000 that no pay till at least tueday,,,,,

 

it will be a hasty departure either way ;)

 

me & the lad that i pick up are being singled out, & in our letters it says he needs to discuss the loss of a major contract... & we know he HASNT lost it, hence why its a hasty departure

Is it just recently that he's been having trouble? If so it might be worth cutting the fella some slack, as times are hard. ;)

 

However, I've worked for an employer like that before, and it was a nightmare. I used to get what I was owed, but it was a pain in the arse because my bills were always late being paid. :wallbash:

Employers have a duty of care to pay your wages, part of the contract drawn up at the start of your employment. Obviously you may get it a day or two late now and again, but if it's a regular thing, he's breaking his side of the contract.
