Foxgun Tom 75
You do seem to have done everything right after the event and that's a credit to you! You will definately get a rebuke from the court for the dog being off the lead, the other guy's injury could have been caused when he kicked out and got scratched, could it be assumed that even his own dog inflicted the wound the @rsehole is complaining about? (your arguement) If your in Scotland make sure you see a solicitor the first 1/2 hour interview is free and you may be entitled to legal aid in certain circumstances?, If this guy admitted kicking and lashing out at your dog to the police? he may have provoked the dog's reaction himself? especially if you have others prepared to make statements about how friendly or docile your dog is. Obviously its a worrying time for you and I sympathise, I'm keeping my fingers crossed you get a ticking off and admonished, the other guy in my opinion seem's to be chancing his arm and making a mountain out of a mole-hill Tom
Guest WEE WEE PANTS
Ive seen a solicitor, and he is getting a collegue who is better qualified in things like this to represent me. I need pics as to what they are dealing with(Dog.), and when i told him a 12 inch patterdale terrier, i think he was shocked and thought i had some monster. Their statements say that i wasnt bothered, but i am, i left the scene quickly as to avoid further trouble. They are saying that their dogs went through a terrible ordeal, and that she is too frightened to walk out at night anymore. They both say that the dog was latched onto his leg, wheres the teeth marks to prove that? On his statment he says that he suffered a 1 and a half inch long gash were the teeth had punctured his foot.

And your dog is not on the Dangerous Dog list. Hope all goes well for you...
Guest WEE WEE PANTS
Ive also been on the phone to the vets, the vet is no longer with the practice, but there are no notes saying that she is in anyway dangerous. They are getting another vet to look at it, and see what they can do in ways of a reference.
Guest WEE WEE PANTS
Apparently the dog is a staffy Cross, which she isnt. Edited October 7, 2010 by WEE WEE PANTS
Guest WEE WEE PANTS
I am taking her to the vets tomorrow to see if she has any conditions that might of made her lash out, ie sore leg. they will also do a proper assessment on her to see if she is Dangerous in anyway. Foxgun Tom 75
Apparently the dog is a staffy Cross, which she isnt. Who said the dog was a staffy X? if this is what it say's on the summons and its factually incorrect? the summons is wrong as the description and breed or breeding of dog is false! Your solicitor should look closely at the wording of the summons and mention the anomaly at any hearing! it might be enough to get it thrown out as the dog's identity is now in doubt? Guest WEE WEE PANTS
Tom, the solicitor has the paperwork, but i will be seeing him tomorrow. Its the woman who said she is a StaffyX. So im not sure whether thats what is on the summons. And thats why they want me at court thinking she is a dangerous breed. Even the witnesses signitures havnt been signed by the officer, as the signiture witnessed by is blank. The solicitor will be very thourough with this.
