Breeding dogs & law?

When reading 'Breeding and Sale of Dogs (Welfare) Act 1999' I note that 5 or more litters requires a license as it is then a business but if you're breeding say three a year & it's classed as a hobby are you supposed to er declare this or is money made from this wrote off as upkeep money for the hobby?

 

Anyone any expierience?

The kc's rule is that a bitch can have 6 litters registered during her lifetime. I think what Chubs is asking is whether you need to declare if your having less than the 5 litters per year which would require the breeder to get a license. Im not sure on this one but I think it applies to all breeds and crossbreeds regardless of kc reg for example hancock has one and he is not a breeder of kc reg or even purebreed dogs but Im sure there is some loophole somewhere that says if you breed less than 5 but are considered bu the local council to be running a business then you need a license. for example if someone had 3 british bulldog bitches and a stud and they bred the 3 bitches and charged £2 for the pups they could possibly make a reasonable amount of money in a short space of time and therefore would be liable to pay tax on that money as its classed as an income. most hobby breeders will just cover their costs its only when you start making big sums of money you get into trouble because people get jealous and the knifes start coming out, its amazing what a bit of harmless extra cash can do to turn the neighbours green with envy :sick:

this topis done to death on another site and the up shot is that yes, after you have paid your expenses any profit must be declared like in any other income situation.

Farlap I dont go on that many forums so I wouldnt know whether or not the topic has been done to death or not. I dont think it matters how many bitches you own J Darcy, you could have a house or a yard full but if you bred from them thats when the rules and regulations would start to come into play :thumbs:

5 or more breeding bitches & more than four litters a year & then a kennel license is required.
