FEO out today

The feo came out today for a friendly chat,i know him fairly well having shot with him for years, so started off on a good note. made him tea etc. this must be the only FEO i know of that has any real and lasting knowledge of firearms and their effects. we talked for a while on different things to do with rifle shooting, he has 50 odd of them! and then returning to the boring business of administration. he noted that i sent a letter from my beat keeper and myself explaining my rifle shooting experience having used a .222 with him for a few years. he asked me to clarify who the man(beat keeper) was and how i came to use his rifle. this is where i need help. i told him that i used his rifle in his company on land which my syndicate holds the shooting rights and he is in 'employ' of the syndicate being a beat keeper. which is perfectly true i just hadnt made it clear. this in my view and interpretation classes his rifle as an estate rifle entitling me to use it, am i correct?

any advice would be appreciated, he seemed to accept this view but......

I rang the BASC to check this a little while ago. Can't remember the details but the upshot is that if you go out with someone who has an FAC, and use their rifle under supervision (and that doesn't have to be close supervision), then that's fine. BASC man told me that if anyone else thought differently, aim them at BASC and they would be put right

Exemptions from the requirement to hold a certificate

 

Shot Guns

 

1968 Act

 

Section 11(5) of the 1968 Act allows an individual, without holding a shot gun certificate, to borrow a shot gun from the occupier of private premises and use it on those premises in the occupiers presence. The presence of the occupier is normally taken to mean within sight and earshot of the individual borrowing the firearm.

 

 

 

Rifles

 

1968 Act

 

Section 16.1 of the Act enables a person to borrow a rifle from the occupier of private premises and to use it on those premises in the presence of either the occupier or their servant without holding a firearm certificate in respect of that rifle.

 

 

 

 

The term "occupier" is not defined in the Firearms Act, nor has a court clarified its meaning. However, the Firearms Consultative Committee in their 5th Annual Report recommended that the provisions of section 27 of the Wildlife and Countryside Act 1981 be adopted. This states that "occupier" in relation to any land, other than the foreshore, includes any person having any right of hunting, shooting, fishing or taking game or fish.
