SSPCA's powers in Scotland

Does anyone know just what their powers are in Scotland. My understanding was that they are no better placed than the RSPCA in England and Wales in gaining access.

 

In Scotland they might be asked by the Sherriff Court to produce a report for the Sherriff. Beyond that I know not.

They're still only a registered charity with employees who have no special powers!! don't give them statements or make comment, don't allow them on your property without a warrant, If being questioned by police, here in Scotland? don't give any information except name and address, thats a legal requirement and only give that information to the police Under no circumstances give an interview with police in the presence of an SSPCA officer ask for them to be removed!!

 

In Scotland you dont have to mention anything you later rely on in court that only applies in England and Wales?, your innocent until the courts prove you guilty beyond reasonable doubt? If you dont allow them the opportunity to take a statement from you, it follows you cant incriminate yourself. In Scotland the police are the investigative body its their job to gather evidence, not the SSPCA!! and its the police who send a report to the Procurator Fiscal The SSPCA cannot charge you with anything? I once had an SSPCA officer stop me and he produced what he said was a warrant card in front of witnesses, it was in fact his SSPCA ID card, he was warned by the police not to say he had a warrant card again as it might be construed by the public he was a police officer? He was warned if he took the same action again he would be charged with impersonating an officer of the crown as they are the only individuals allowed a warrant card? In brief: tell them "Feck All: and dont allow entry without police and a valid warrant to search and sieze items

Shows how much you know tom, the sspca report direct to the fiscal, no police needed or involved, its the fiscal who decides whether or not to prosecute. Ask sue - she knows how things stand between the public and the sspca, you screamed, gloated and cheered long enough about that incident , shame (not)you were one of the individuals left with egg on your faces, and you still havent learnt, anyone who takes heed of your above post is doomed. the sspca do not need the police in scotland they have that power , its not the same in england though.

Ps: 10/22 OK! they can report to the fiscal if he asks and other circumstances, (if you don't give a statement thats less evidence against you, Allow the SSPCA to waste their time and money gathering evidence which may or may not come to court, they don't have infinite rescources, they depend on donations for finance?) but they still can't charge you or enter your premises cart-blanche they need sufficient reason and a warrant, Also an individuals right not to make a statement or incriminate himself in Scotland is a right that is paramount here!!! No-one should volunteer information that may drop them in the shit especially if the Scottish legal system allows you the right to silence and not give evidence against yourself?, why make it easy for someone to convict you??

and whys that?, cos I dont fawn over some second rate interfearing old git who thinks hes important yet knows sod all, the only pricks are folk who take any notice of him. Asks SACs

 

but if you are interested and read his link, it basically says the sspca can do what the hell they like when they like and dont need to justify buggar all to anyone bar the fiscal, and thats just what they do
