Trouble with these FEO is no-one is singing from the same hymn sheet. Each County can be different.

I had a two shot .22 for humane dispatch and decided I wanted something bigger so ased to exchange it for a .410 DB pistol.

This was no problem but they would only state on cert that .410 was to be used on "vermin around buildings" not humane dispatch!!!

I live three miles from the border of next county where FEO are happy to issue terriermen to use .32 pistol. I tried for variation but got turned down flat.

My FEO always has his BASC Manual with him for guidance and his Home Office Guidelines as reference.

 

I also think that as he has been in 'the job' and a Police Firearms Officer for over 20 years, he's been round the block and knows his stuff.

 

Younger FEO's would have been brought up in the 90's+ only knowing that firearms are dangerous, used by bank robbers and other criminals and feral gangs.

 

We all get painted with the same pot of dirty paint.

 

If you have BASC Membership, call their Firearms Department and they will fight your corner, thats why you pay membership fees.

FEO has rung today to say that he's coming round tomorrow to take back my certificate so he can change it to a two shot revolver.

 

I have also spoke to the dealer I bought the pistol off and he's offered a full refund and in his words it's not worth fighting as the tossers will just drag it on for forever and a day.

Do you think it's worth holding back my firearms certificate, so i could appeal against this desicion. The way I see it once I've given back my certificate and allowed the variation to be placed on it, it would be to late to change my mind and fight my corner.

phone basc this morning and ask what the crack is. i would then follow their advice.

it seems the feo may well have "a bee in his bonnet" about something or other( maybe having said "no" and you getting it through,this is a problem between him and his gaffer imho.

 

i'm not sure you can refuse to hand over the cert' but basc will advise you on that too( if you do have to hand it over then make sure you have a photo copy and get him to sign or initial it).as is mentioned above you have done nothing wrong( have kept to the conditions of the cert) and untill you do place in the offensive magazine.............

Personally, I'd fight it! I do not believe that you can allow state officials to go about making the law up as they see fit. He's won so what's he going to yank off someone's ticket next when he decides that he doesn't like how the law works?

 

However, if you are going to go down this route, then I would suggest that you insist very firmly that he does it by the book; he should do all the paperwork to revoke the authority for the semi-auto pistol - which will require him giving reason and giving you formal notice in writing and of your right to appeal.

 

Like I say though, I'd fight it because, quite honestly, from your description of events the cops can't win this one.

Yes, definitelty! He has no authority to do this without going through the proper revocation procedure. So, not only is he making the law up as to what you are entitled to possess he is openly breaking the law as to how authorisations should be revoked. There is a requirement that the cert holder be notified of a revocation in the manner set down by Parliament.

 

Also, do remember, that whatever the outcome - this pistol is YOUR property, not property of the cops. Even if you end up not being allowed possession of it you still have legal title to it.
