How would it stand ???

I know you can still use dogs to push fox's to guns, but where would we stand if you shot a fox didnt kill it out right but then the dogs got hold and killed it ????? and no before any one ask's no its not happened to me, it just got me thinking the other day.

if its no longer safe to take a secand shot eg no back drop, hoses people dogs in the way, ect it should be fine as the intension was to shoot the fox not chase it so the dog is simple retriveing and dispacting wounded qurry which as far as i know is perfectily legal.
