Boundary Positions

This argument has been done to death, and is totally irrelevant to the OP's post as it only applies to England and Wales, and he's about as far as you can get from England and Wales within the UK.

 

I still say if he fires from outside the boundaries of his permission then he is committing an offence. If he stays within the boundary fence then he isn't.

 

Thanks for your answers guys. The reason for my confusion about were my permission ends is due to how far the boundary fence is from the road (4-5 meters). for instance on my own croft my old man fenced it off about 50 yards parallel from the road but its still my land down to the road upto a certain distance (I was told that the relevant authority has jurisdiction for upto 15 feet from the centre of the highway). My next door neighbour fenced his croft upto a yard from the road so hence l think that my permission could extend outwith the boundary fence between the permission and road.

 

I think the best way forward would be to talk to the landowner about were his actual land ends especially as his brother in law is a lawyer who specializes in property law and property sales so he maybe able to look it up for me.
