panda 0
Had the dogs out for a walk through the local fields earlier when some tool comes flying up the hill in a discovery shouting what the F**k you doin. Replied with "walking the dogs",anyway he trys to tell me im not allowed on his land and im trespassing. After explaining to him theres no Trespassing laws in Scotland he then decides dogs should be on lead and i can only walk round the outside of fields. After explaining that dogs wernt causing any probs and there wasnt any livestock in field i put dogs on lead and told him i couldnt be botherd arguing and made my way down the hill and onto road. What made it worse was last twice his cows have been out on the road i went round and told him. So can anyone clarify exactly what rights i have. Cheers Panda
Foxgun Tom 75
Its a fallacy to suggest there's no trespass laws in Scotland there is , just some of the trespass offence's in Scotland that come to mind!! armed trespass, tresspass in the pursuit of game, trespass with criminal damage, trespass with intent (harder to prove) He is right to ask that you keep dog on a lead especially if he has livestock? If he asks you to walk round the outside of fields it might be that he has growing crops? and does'nt want them damaged (grass is a crop (silage) As for his cow's are out on the road? and cause an accident or loss he is responsible and can be sued especially if he's been told twice about the problem!! In Scotland non trespass only occurs when your commiting none of the above offence's and not on Ministry of Defence or Crown property? Tom Ps: You can cross land from A-B with a firearm in its slip or cover, if?? B is the land you have permission on!!
